FANTASY HUB TERMS AND CONDITIONS

If you want to enter a Fantasy football team ("Team") into one of the Fantasy football leagues operated and provided by CheckdMedia Limited through the Fantasy Hub mobile application (the "Fantasy Hub App"), online or Facebook Connect you need to read each of Sections A, B and C of these terms and conditions.

By downloading the Fantasy Hub App or registering a Team through the Fantasy Hub App, Facebook Connect or via the Sites (together, the “Services”), you agree to be bound by these terms and conditions (which include Sections A (Fantasy Hub Leagues), B (Fantasy Hub Competitions) and C (General Information)) (the “Terms and Conditions”).

These Terms and Conditions (including our Privacy Policy) may be changed at any time. We will ensure that any new or revised version is posted in the Fantasy Hub App, on the Sites and on our Facebook page and will send notification of any changes to the email address you used to register for a Fantasy Hub account before the change takes effect. The new or revised version of the Terms and Conditions will take effect immediately the next time you log in to your Fantasy Hub account through the Fantasy Hub App, Sites, Twitter login or Facebook.

The promoter of the Fantasy Hub Competitions (described in Section B below) is CheckdMedia Limited Ascendis Unit 3, Building 2, The Colony Wilmslow, Altrincham Road, Wilmslow, Cheshire, England, SK9 4LY (“CheckdMedia Limited”, “we” or “us”).

• A. FANTASY HUB LEAGUES

  WHAT ARE THEY?

  1. 1. The Fantasy Hub Leagues are fully automated free to enter Fantasy football leagues. You can enter a Team into any (or all) of the Fantasy leagues ("Fantasy Leagues") available to enter from time to time.

• WHO CAN REGISTER A TEAM?

  1. 2. You can register a Team if you live in the United Kingdom, or in any other country where participating in Fantasy football competitions is legal. If you live outside the United Kingdom and register a Team, you promise us that it is legal for you to do so. By registering a Team and participating (and continuing to participate) in the Fantasy Hub Leagues, you acknowledge that you have read, understood and agreed to such terms. Please see paragraphs 22-24 for further information.

• HOW CAN I REGISTER A TEAM?

  1. 3. Before you can register a Team, you must register for an account with Footy Accumulators (“Account”). You can register for an Account:
     1. a.by downloading the Fantasy Hub App to a compatible device and either: (i) completing a simple registration form, providing us with some basic information about yourself (including your name, date of birth and email address; or (ii) selecting to register using Facebook Connect (Facebook will provide the information we need for you) or
     2. b.by completing a simple registration form on the Sites.
  2. 4. When providing us with information about yourself during registration of a Team, you promise us that this information, including your date of birth, is correct. You acknowledge that we will rely on this information when determining the information and features you will receive when using the Services. If we discover that you have provided any information which is incorrect, we reserve the right to close your Account (and remove your Team(s) from the Fantasy League(s)) immediately.
  3. 5. After registering for an Account you will be asked to verify your email address. It is recommended that you do this as soon as possible, as you will not be eligible to receive a prize if you have not verified your email address.
  4. 6. Once you have completed the application process, you will be able to select which Fantasy League you would like to enter a Team into, the players for your Team, and your very own Team name.
  5. 7. You may not open more than one Account.
  6. 8. CheckdMedia Limited may suspend or close your Account if it believes:
     1. a. you have more than one Account; and/or
     2. b. you have failed to comply with any other provision of these Terms and Conditions.

  7. IS THERE A DEADLINE FOR REGISTERING A TEAM?

     1. 9. No - you can register a Team at any time for any Fantasy League.
     2. 10. If you register a Team after the start of the season for the applicable Fantasy League, your Team will start to collect points from the start of the next match (as applicable).

  8. DOES IT COST ANYTHING TO REGISTER A TEAM?

     1. 11. No! You can register up to five (5) teams absolutely free for each of our Fantasy Leagues.

  9. HOW DO I SELECT MY TEAM?

     1. 12. After you have completed the registration process and selected which Fantasy League you want to enter a Team into, you will be provided with a list of all eligible players to select from, together with the 'value' of each player.
     2. 13. You must select 11 players to form your Team, but remember that the total value of all the players you select cannot exceed the standard Team budget (which will be displayed when selecting your Team, and is the same for all Managers). Your Team must be formed of the number of defenders, midfielders and forwards that corresponds to the applicable formation selected and may have a maximum of four players from any one club.
     3. 14. The value assigned to each player is calculated by ourselves on the basis of the player's popularity with all of the registered Managers (which is linked to their real-world performance and situation), and will change throughout the season (for example, if a player's performance improves greatly, he might become popular in the Fantasy Leagues, which would result in an increase in his value).

  10. CAN I TRANSFER PLAYERS?

      1. 15.Yes! Use our PlayerDAQ to monitor the value of players in the league and decide when to transfer out underperforming or unavailable players in order to strengthen your squad.
      2. 16.You can make a number of free transfers every week. The number of free transfers can vary and are displayed in the 'Transfers' tile of the home screen.

  11. HOW DO I SCORE POINTS?

      1. 17. Points are awarded when one of the following events occurs for a player in your Team during a match:

         Penalty Taker - Penalty missed	-3

      3. 18.CheckdMedia Limited's decision regarding the points to be awarded for players will be final.

  12. CAN I INTERACT WITH OTHER MANAGERS?

      1. 19.Yes, we encourage you to interact with other Managers by:
      1. a.challenging them to head to head games;
      2. b.posting comments to posts on our News Feed; and
      3. c.using our private message function.
      2. 20.We expect all Managers to treat other Managers with respect, and we will not tolerate any use of abusive, offensive, discriminatory, obscene or sexual language when posting comments or sending private messages. We reserve the right to remove any posts, delete any private messages and/or cancel your registration with CheckdMedia Limited (and remove your Team(s) from the Fantasy League(s)) immediately if, in our sole discretion, we consider that you have not complied with our Code of Conduct (see paragraph 34 below).

  13. B. FANTASY HUB COMPETITIONS

      Fantasy Hub provides all Managers with the chance to win great prizes based on the number of points collected or the value of your Team! The following terms and conditions apply to all Fantasy Hub Competitions:

  14. WHAT ARE THE FANTASY HUB COMPETITIONS?

  1. 21. A list of the Fantasy Leagues that are currently available, and the Fantasy Hub Competitions that apply to each, can be found on the Create New iTeam and Comps pages within the Fantasy Hub App and on the Sites.

  2. WHO CAN ENTER THE FANTASY HUB COMPETITIONS?

     1. 22.Subject to Paragraphs 23 and 24, every Manager with a Team in a Fantasy League is eligible for the Fantasy Hub Competitions applicable to that Fantasy League. As soon as you have registered with Fantasy Hub and selected your Team, you will be entered into the applicable Fantasy Hub Competition(s).
     2. 23.The Fantasy Hub Competitions are open to residents of the United Kingdom and all other countries where entering the Fantasy Hub Competitions is legal. If you live outside the United Kingdom, we reserve the right to withdraw your eligibility for the Fantasy Hub Competitions at any time and without notice if we think it might be unlawful to allow you to enter the Fantasy Hub Competitions. If you live outside the United Kingdom and enter a Team the Fantasy Hub Leagues, you promise us that it is legal for you to participate in the Competitions.
     3. 24.Employees of the Promoter, a Partner (as defined in paragraph 32 below) (including any of their parents, subsidiaries and affiliates), an immediate family member of an employee of CheckdMedia Limited or Partner or otherwise professionally connected to the Fantasy Hub Competitions are ineligible to win a prize in any Fantasy Hub Competition.

  3. DOES IT COST ANYTHING TO ENTER FANTASY HUB COMPETITIONS?

     1. 25.No. It is free to enter and you register up to give (5) Teams for each of the Fantasy Leagues. Each Team you manage will mean one entry to each applicable Fantasy Hub Competition.

  4. HOW WILL THE WINNERS BE NOTIFIED?

     1. 26.CheckdMedia Limited will notify the winner of each Fantasy Hub Competition by email to the email address provided by the Manager when registering with Fantasy Hub within 7 days of the end of the applicable competition period.
     2. 27.If: (i) an email is returned as undeliverable; (ii) a winner fails to respond to the prize notification email within 72 hours; or (iii) a winner does not comply in any other way with these Terms and Conditions, that winner may be disqualified and, at CheckdMedia Limited's sole discretion, the prize may be awarded to the next highest placed Team.

  5. WHAT ARE THE PRIZES?

     1. 28.The prizes for each of the Fantasy Hub Competitions are set out in the leaderboards section of the application and site.
     2. 29.Where applicable, the prize includes the cost of delivery to an address in the UK. All taxes and all other costs and expenses associated with prize acceptance and use are the sole responsibility of the winner.
     3. 30.Winners may not substitute, assign or transfer a prize or redeem a prize for cash, but CheckdMedia Limited reserves the right, at its sole discretion, to substitute a prize for the applicable cash value of the prize or to provide the winner with eVouchers of the applicable value with which to purchase the prize from a local retailer.

  6. C. GENERAL INFORMATION

     WHAT ABOUT MY PRIVACY?

     1. 31. You are required to provide your email address and other information about yourself (including your name, date of birth and favourite football team) in order to register with Fantasy Hub and set up a Team. Unless you have notified us otherwise, you acknowledge that we may send you information or offers about our products, promotions and services. If you ticked the relevant box when you registered, your email address may be provided to the Partner(s) (as defined in paragraph 32 below) for marketing purposes but will not otherwise be sold or rented to third parties.   7. WHAT OTHER IMPORTANT INFORMATION DO I NEED TO KNOW?

     1. 32.The Fantasy Hub App may contain links to the websites and mobile applications of our marketing partners and our betting partners (each a "Partner"). CheckdMedia Limited accepts no responsibility for any act or omission of the Partners, any information or materials provided to you by a Partner, any content on the Partners' websites and/or any loss or damage suffered as a result of accessing the Partners' websites and/or mobile applications through the links provided within the Fantasy Hub App.
     2. 33. To access the services provided by our betting Partner, you must be at least 18 years old, resident in Great Britain, or another country where it is legal to gamble with our betting Partner, and have signed up for an account with the betting Partner (including passing any age or identity verification checks required by the Partner).
     3. 34. You must comply at all times with our code of conduct ("Code of Conduct") when accessing or using the Services. You agree that you will not:
     1. a.post any inappropriate content, including (without limitation) any content which is harmful, abusive, vulgar, harassing, threatening, sexually explicit or provocative, pornographic, defamatory, libellous, obscene, embarrassing, invasive of another's rights to privacy (including distributing another's personal information), hateful, racist, homophobic or otherwise discriminatory;
     2. b.promote or encourage any illegal activity including, without limitation, hacking, cracking or distribution of counterfeit software, or cheats or hacks for the Sites, Fantasy Hub App, our Twitter page, Facebook page, or the use of illegal drugs;
     3. c.strict or inhibit any other user from using and enjoying the Fantasy Leagues (for example by disrupting the flow of chat in the Newsfeed with vulgar language, abusiveness, hitting the return key repeatedly, inputting excessively large images so the screen goes by too fast to read, use of excessive SHOUTING (all caps) in an attempt to disturb other users, "spamming," or flooding (continuous posting repetitive text);
     4. d.violate the terms of any other applicable agreement or terms governing the access or use of the Services (including any end user licence, code of conduct or other terms of use/service or guidelines from any web site on which the Services are available);
     5. e.use, upload, transmit, distribute or otherwise make available any content, including images or photographs, which are made available through the Services that infringes any copyright, trademark, privacy, publicity or other proprietary right of any party;
     6. f.except as expressly authorised by us, advertise or offer to sell or buy any goods or services or exploit the Sites, Fantasy Hub App, our Facebook page or Twitter page or any of its parts for any commercial purpose;
     7. g.collect (in an automated manner or otherwise) personal information about others, or impersonate or create a false identity (such as a celebrity, web site administrator or a CheckdMedia Limited representative) for the purpose of misleading others (including attempting to obtain password, Account, or other information from a user);
     8. h.use the Services (including bulletin boards and other communications services) in any manner other than for personal communication as an individual user (i.e. sending surveys, contests, pyramid schemes, chain letters, junk email, spam or any duplicative or unsolicited messages); or
     9. i.use the Services for fraudulent transactions or for any purpose that violates any applicable local, state, national, or foreign laws, regulations, or treaties.
     10. j.cheat or use, develop or distribute automation software programs ("bots"), "macro" software programs or other "cheat utility" software program or applications which are designed to modify the Fantasy Hub experience to the detriment of fair play;
     11. k.set up multiple Accounts or otherwise carry out dishonest or fraudulent activities in order to take advantage of promotions that may be offered from time to time by CheckdMedia Limited or otherwise to circumvent the rules set out in these Terms and Conditions;
     12. l.disrupt, attempt to, or otherwise assist in the disruption of any computer used to support the Sites, Fantasy Hub App, Twitter or Facebook services;
     13. m.upload files that contain viruses, Trojan horses, worms, time bombs, corrupted files or data, or any other similar software or programs that may damage the operation of the Fantasy Leagues or other users' computers;
     14. n.reproduce, translate, reverse engineer, modify, disassemble, or decompile, in whole or in part, or create derivative works of the Sites, Fantasy Hub Fantasy App, our Twitter page or our Facebook page, except to the extent permitted by applicable law.
     4. 35. CheckdMedia Limited, and its parents, affiliates, subsidiaries, advertising and promotion agencies, the Partners and each of their officers, directors, shareholders, employees, agents and representatives accept no responsibility for any:
     1. a.incorrect allocations of points, inaccurate player values, delayed, incorrect or misdirected player selections, transfer or Team registrations;
     2. b.interrupted or unavailable network or server or any problems or technical malfunction of any telephone network, online systems, servers, or providers, computer equipment or software malfunction; and/or
     3. c.viruses or other technologically harmful material that may infect your mobile phone or computer equipment or other proprietary material due to your use of the Services.
     5. 36. You are responsible for maintaining the confidentiality of your Account information (including usernames and passwords) and are responsible for any and all activities that occur under your Account. You must notify us immediately of any unauthorized use or theft of your Account or any other breach of security. We will not be liable for any loss that you may incur as a result of someone else using your Account, either with or without your knowledge. You are responsible for the activities occurring under your Account and you will be liable for any losses or damages incurred by CheckdMedia Limited or another party due to someone else using your Account. You may not use anyone else's Account at any time. Your Account is personal to you and you may not transfer or make available your Account to others. Any distribution by you of your Account or related information may result in cancellation of your Account without refund.
     6. 37. You acknowledge and agree that all content, including, without limitation, all Accounts, characters created, and virtual items or in-game currency acquired and developed as a result of game play, are the sole and exclusive property of CheckdMedia Limited and may be used by CheckdMedia Limited (and/or its affiliates, publishing partners, distributors, licensors and licensees) for any purpose, including for commercial or promotional use. You agree that you may only upload or otherwise transmit on or through the Services content that does not infringe the intellectual property rights of any third party, and you represent and warrant that any content you do transmit will not infringe the intellectual property rights of any third party.
     7. 38. The Fantasy Hub Leagues and Fantasy Hub Competitions are not official games or competitions of any football league, federation or other organisation that owns, manages, controls or is otherwise related to the football league or competition applicable to any Fantasy League, including the English Premier League and UEFA Champions League (“Football Organisation”). The Fantasy Hub Leagues and Fantasy Hub Competitions are in no way sponsored, endorsed or administered by, or associated with Facebook, Inc. (“Facebook”), Twitter International Company (“Twitter”) or any Football Organisation. Facebook, Twitter, Football Organisations and their parents, affiliates, subsidiaries, and advertising and promotion agencies, and their officers, directors, shareholders, employees, agents and representatives of them in no event accept any liability howsoever arising for any loss, damage, cost or expense any person may incur as a result of participating in, or seeking to participate in, the Fantasy Hub Leagues and/or Fantasy Hub Competitions.
     8. 39. CheckdMedia Limited does not accept any liability however arising for any losses you may incur as a result of registering with CheckdMedia Limited, entering a Team into a Fantasy Hub League or as a result of accepting any prize.
     9. 40. CheckdMedia Limited cannot promise that the services relating to the Fantasy Hub Leagues and Fantasy Hub Competitions will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of CheckdMedia Limited.
     10. 41. Nothing in these Terms and Conditions affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
     11. 42. If any provision (or part of a provision) of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force. If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the parties.

  8. WHAT SHOULD I DO IF I HAVE A QUESTION OR COMPLAINT?

     1. 43.If you have any concerns, questions or comments about the Fantasy Hub Competitions or these Terms and Conditions, please contact us at feedback@footyaccumulators.com or in writing at CheckdMedia Limited Ascendis Unit 3, Building 2, The Colony Wilmslow, Altrincham Road, Wilmslow, Cheshire, England, SK9 4LY .
     2. 44. CheckdMedia Limited’s decisions in all matters to do with the Fantasy Hub leagues and Fantasy Hub Competitions will be final unless you dispute such decisions: (i) by contacting us as described above, or (ii) in accordance with paragraph 45 below.
     3. 45. The English courts will normally have jurisdiction over any claim arising from, or related to, the Fantasy Hub Leagues and Fantasy Hub Competitions, unless you choose the courts of your home in another member state of the European Economic Area. We retain the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.
     4. 46. These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the law of England and Wales.
